PRACTICAL GUIDE FOR THE IMPLEMENTATION OF THE LAW ON AMENDMENTS OF THE LAW ON ENFORCEMENT AND SECURITY

To support the Ministry of Justice in the implementation of the reformatory solutions introduced by the Law on Amendments of the Law on Enforcement and Security, the Project developed a Practical Guide for the Implementation of the Law on Amendments of the Law on Enforcement and Security.

The Practical Guide will serve as a key reference point for all interested parties guiding them through the specifics underpinning the implementation of the novelties for the enforcement system as prescribed by the new Law. The Practical Guide is developed as a summary comment of the new legislative solutions, given the comprehensive and substantial changes brought by the amendments to the Law on Enforcement and Security. The Guide also provides underlying reasons for regulatory interventions, starting from the identified problems in implementation of the previous law, thus seeking to establish a deeper understanding of the new law among practitioners.

The Practical Guide provides commentary of Amendments to the Law on Enforcement and Security. It is divided into chapters referring to institutes of enforcement procedure that have been introduced, changed or abolished. The most important novelties that have been scrutinised include: jurisdiction of enforcement courts and public enforcement agents; proportionality principle in enforcement procedure; protection of enforcement debtor; reduction of costs of enforcement proceedings; enforcement against immovable property; changes to the other methods of enforcement and security; summary enforcement procedure; supervision of public enforcement agents; transfer of old enforcement cases to public enforcement agents. It shall be noted that further issues may arise in practice, as some of the norms analysed are only being applied as of 2020.
